This Policy is designed to ensure compliance with <em>The Public Charge Point Regulations 2023<\/em>, including provisions regarding reference data, availability data, and tariff data for public charge points in the United Kingdom.<\/p><h2>1. Scope and Purpose<\/h2><ol><li>Regulatory Compliance: Wenea is committed to meeting the open data requirements mandated by the UK government, including accurately maintaining and opening charge point data to the public by 24 November 2024, in accordance with <em>The Public Charge Point Regulations 2023<\/em>.<\/li><li>Data Coverage: The Data we provide will include:<ul><li>Reference Data: Location details, connector types, pricing, payment methods, and time restrictions (where applicable).<\/li><li>Availability Data: Real-time operational status of each Electric Vehicle Supply Equipment (EVSE), updated within 30 seconds of status changes.<\/li><\/ul><\/li><li>Machine-Readable Format: All required Data will be made available free of charge, in a machine-readable format, to ensure ease of automatic processing.<\/li><\/ol><h2>2. Acceptable Use<\/h2><ol><li>Permitted Access: We grant you limited access to our API to view and use the Data in accordance with The Public Charge Point Regulations 2023.<\/li><li>Prohibited Actions: You must not engage in any activity that disrupts, harms, or otherwise interferes with our API, including but not limited to unauthorised access attempts, malicious attacks, or other forms of abuse.<\/li><li>No Modification of Service: You must not alter the functionality of Wenea\u2019s services. We reserve the right to restrict or throttle your API usage if your access patterns violate this Policy or risk impacting service availability.<\/li><\/ol><h2>3. Data Accuracy and Frequency<\/h2><ol><li>Timeliness: We will endeavour to ensure that all reference data is accurate when published and that availability data is updated within the government-mandated timeframes.<\/li><li>Data Updates: If an EVSE\u2019s operational status changes, we will reflect this in our availability data within 30 seconds.<\/li><li>Non-Compliance: If certain data fields are not technically feasible to provide, we will maintain evidence of the reasons and cooperate with the enforcement authority\u2019s inquiries.<\/li><\/ol><h2>4. Security Measures<\/h2><ol><li>API Credentials: You are responsible for safeguarding any API keys or access tokens issued to you by Wenea.<\/li><li>Confidentiality: Any compromise of your API credentials must be reported to us immediately so we can take appropriate steps to secure the Data and the API.<\/li><\/ol><h2>5. Monitoring and Enforcement<\/h2><ol><li>Usage Oversight: Wenea may monitor API usage to ensure compliance with this Policy, to maintain service quality, and to prevent unauthorised activities.<\/li><li>Rate Limits: We may impose rate limits or other technical controls on your use of the API at our discretion to maintain system integrity and performance.<\/li><li>Suspension or Termination: In the event of a breach of this Policy or relevant laws, we may suspend or permanently terminate your access without prior notice.<\/li><\/ol><h2>6. Ownership<\/h2><ol><li>Wenea\u2019s Rights: All rights, title, and interest in the Data and the API remain with Wenea. Nothing in this Policy transfers any intellectual property rights to you or any other party.<\/li><\/ol><h2>7. Open Government Licence<\/h2><ol><li>Free-of-Charge Data: Our Data is made publicly available free of charge and under open terms, aligning with the Open Government Licence requirements for machine-readable formats.<\/li><li>Data Accessibility: We will make the Data available to any party that wishes to receive it, typically through our API or other suitable automated communication methods.<\/li><\/ol><h2>8. Disclaimer<\/h2><ol><li>As-Is Basis: To the fullest extent permitted by law, we provide the Data and the API \u201cas is.\u201d We make no warranties, whether express or implied, regarding its accuracy, completeness, or reliability.<\/li><li>Updates and Revisions: We may revise or update the Data at any time. You are responsible for ensuring you have the latest version of our Data.<\/li><\/ol><h2>9. Indemnification<\/h2><p>You agree to indemnify and hold Wenea, its officers, employees, and affiliates harmless from and against any losses, liabilities, or damages arising from your use of the API and the Data, including any claims or disputes involving third parties.<\/p><h2>10. Limitation of Liability<\/h2><p>To the maximum extent permitted by law, Wenea shall not be liable for indirect, incidental, consequential, or special damages resulting from your use or inability to use the API or the Data.<\/p><h2>11. Updates to This Policy<\/h2><p>We may update this Policy periodically to reflect changes in regulation, technology, or our operational procedures. The latest version will be posted on our website, and continued access to the API constitutes acceptance of the updated Policy.<\/p><h2>12. No Partnership<\/h2><p>Nothing in this Policy establishes any partnership, agency, or joint venture between Wenea and users of the Data or the API.<\/p><h2>13. Jurisdiction<\/h2><p>This Policy is governed by and construed in accordance with the laws of England and Wales. Any dispute arising under it shall fall within the exclusive jurisdiction of the English courts.<\/p><h2>14. Data Protection<\/h2><p>In the event that users access the information through an API, we inform you that in accordance with the Data Protection Act 2018 and the UK-GDPR, Wenea Services UK Limited (Wenea, we, us or our), email for notification purposes <a class=\"link2\" href=\"mailto:privacidad@wenea.com\">privacidad@wenea.com<\/a>, will process your personal data, acting as the Data Controller.<\/p><p>Wenea will process your personal data for the purpose of managing your registration in the API, for which, at least, your identification data (full name) will be processed.<\/p><p>Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to request access to your personal data, request correction of the personal data that we hold about you, request erasure of your personal data, object to processing of your personal data where we are relying on a legitimate interest, request restriction of processing of your personal data, request the transfer of your personal data to you or a third party, and withdraw consent at any time where we are relying on consent to process your personal data.
